Buying a Plot in Vrindavan
from Abroad

What FEMA allows, how to pay, signing through a power of attorney, and the documents to check — for NRIs and OCIs in the US, UK, Canada, the Gulf and elsewhere.

Quick Answer

NRIs and OCIs can generally buy a residential plot in Vrindavan under FEMA rules — just not agricultural land, plantation property or a farmhouse. Pay through normal banking channels (inward remittance or an NRE, NRO or FCNR account), and you can sign through a registered power of attorney if you cannot travel. Check the project's RERA registration and take a chartered accountant's advice on tax.

What FEMA Allows

This is a general summary. Rules are updated from time to time — confirm your own situation with your bank before you pay.

Step by Step

  1. Pick a RERA-registered project. Search its number on up-rera.in. Omaxe Eternity 2 is UPRERAPRJ141620/12/2025.
  2. Get the documents first. Brochure, price list, RERA certificate and the official cost sheet — we send these on WhatsApp before any commitment.
  3. Arrange a representative if needed. A lawyer-checked, registered power of attorney lets someone in India sign and attend registration for you.
  4. Pay through banking channels. Book with the developer from your NRE, NRO or FCNR account or by inward remittance, and keep every bank advice.
  5. Deduct TDS where it applies. The developer price lists say buyers deduct 1% TDS under section 194-IA when the price is above ₹50 Lakh.
  6. Register and keep records. Keep the allotment letter, agreement, payment receipts and registered sale deed together — you will need them when you sell or repatriate.

Tax — Get Advice Before You Buy

Capital gains tax, TDS on a future sale, and relief under the tax treaty with your country of residence all depend on current rules and your own situation, so we do not quote rates. A chartered accountant who works with NRIs — for example GSRC Associates — can work out your position before you book.

Frequently Asked Questions

5 answers

Can NRIs buy residential plots in Vrindavan?

Under FEMA rules, NRIs and OCIs are generally permitted to buy residential and commercial property in India, but not agricultural land, plantation property or a farmhouse. A plot in a RERA-registered residential township such as Omaxe Eternity 2 falls in the permitted category. Confirm your own case with your bank before booking.

How do NRIs pay for the property?

Payments must come through normal banking channels — an inward remittance from abroad, or funds in an NRE, NRO or FCNR account. Cash, traveller's cheques and foreign currency notes are not accepted for this purpose. The Eternity 2 plot price list states that payments are made in favour of "Omaxe Ltd Collection Account for Eternity-2 Vrindavan".

Do I need to travel to India to buy?

Not necessarily. A properly executed and registered power of attorney can allow a trusted person in India to sign documents and attend registration on your behalf. Have a lawyer draft or check the power of attorney so the sub-registrar accepts it.

Is TDS deducted on the payments?

The developer price lists state that where the total sale price is above ₹50 Lakh, the buyer must deduct and deposit TDS at 1% on each payment under section 194-IA of the Income Tax Act. Your chartered accountant can confirm what applies to you.

What about tax when I sell later?

Capital gains tax and TDS rules for NRI sellers change from time to time, and relief may be available under the tax treaty with your country of residence. We do not quote rates — please take advice from a chartered accountant before you buy and before you sell.
